PRETERM INFANT NUTRITION PRODUCTS LIABILITY LITIGATION

There are several NEC baby formula class-action lawsuits. The multidistrict litigation (MDL), which is now underway (In re: Abbott Laboratories, et al., Preterm Infant Nutrition Prod. Liab. Lit.–MDL No. 3026), includes the manufacturers of both Enfamil and Similac. The MDL judge is Judge Rebecca Pallmeyer in the Northern District of Illinois.

July 1, 2022 Update:

Federal NEC baby formula class-action lawsuit. The judge issued a proposed order to allow plaintiffs to file NEC formula lawsuits against Abbott and Mead Johnson directly in the MDL. It will no longer be necessary for new plaintiffs to file their cases in their home district and then have them transferred into the MDL.

June 17, 2022 Update:

Thirty-seven new plaintiffs were added in the first month of the newly formed preterm infant formula NEC MDL in the Northern District of Illinois. NEC formula lawyers expect to see an average of 30–60 new cases added to the MDL each month from now through the end of 2022. The pace of new lawsuits added to the class action will likely slowdown in 2023.

The Similac NEC lawsuits have now been consolidated into an MDL, which has been assigned to Judge Pallmeyer. Hence, if you file a similar lawsuit in federal court in Texas, New York, California, Michigan, or any other state, the case will be transferred to Judge Pallmeyer in the Northern District of Illinois.
